1. Agreement to these Terms
These Terms of Service (“Terms”) govern your use of WiseEnding (the “Service”) at wiseending.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. What WiseEnding is — and is not
WiseEnding is a private tool that helps you organize your life and legacy: your assets, debts, money owed to you, important records and documents, trusted people, giving intentions, and instructions, plus a “Legacy Heartbeat” that can share what you’ve prepared with people you choose after a period of inactivity.
WiseEnding is NOT a law firm, financial adviser, tax adviser, bank, or executor, and it does not provide legal, financial, tax, or estate-planning advice. It is not a substitute for a legally valid will, trust, or professional advice. For binding arrangements, consult qualified professionals in your jurisdiction.
3. Your account
You sign in with Google. You are responsible for keeping access to your account (and, where you enable end-to-end encryption, your recovery credentials) secure. You must provide accurate information and are responsible for activity under your account. You must be at least 18 years old (or the age of majority where you live).
4. Your content and ownership
You own the information and files you add (“Your Content”). You grant WiseEnding only the limited licence needed to host, process, encrypt, back up, and display Your Content to operate the Service for you and to release it to the people you designate under your instructions.
We do not sell Your Content, and we do not use it for advertising. You can export or delete Your Content, and delete your account, at any time.
5. Acceptable use
- Don’t upload content you have no right to store or share.
- Don’t use the Service for anything unlawful, harmful, or fraudulent.
- Don’t attempt to breach security, access other users’ data, or disrupt the Service.
- Don’t upload malware or attempt to reverse-engineer the Service.
6. The Legacy Heartbeat and release
You configure the Legacy Heartbeat: how often you check in, who your trusted people are, and what each of them may receive. If you stop checking in for the period you set, and after reminders and a grace window, the Service may release the information you designated to your verified trusted people.
You are responsible for keeping your beneficiaries and their contact details accurate, and for reviewing your settings. WiseEnding acts on the plan you configure; it is not a legal executor and does not guarantee any particular legal effect of a release.
7. Plans, billing and refunds
The Service offers a free tier and one or more paid tiers with higher storage and additional features (for example, video and audio messages, spreadsheets, and larger or unlimited document storage). Free-tier limits (such as storage and file counts) apply and may change.
Paid plans are billed through our payment processor on a monthly or yearly basis and renew automatically until cancelled. You can cancel anytime; access continues until the end of the paid period. We may change pricing with reasonable notice. Taxes may apply.
8. Privacy and security
Our handling of your data is described in the Privacy Policy. Your data is encrypted in transit and at rest, and access is isolated to your account. Where you enable end-to-end (client-side) encryption for sensitive fields or files, we cannot read that content — and we cannot recover it if you lose your passphrase and recovery code.
9. Availability and changes
We work to keep the Service available and reliable, but it is provided on an “as is” and “as available” basis. We may add, change, or discontinue features. We may suspend or terminate accounts that violate these Terms.
10. Disclaimers and limitation of liability
To the fullest extent permitted by law, WiseEnding disclaims all warranties, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that a release will occur exactly as intended in every circumstance.
To the fullest extent permitted by law, WiseEnding’s total liability arising from the Service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, or consequential damages, or for loss of data to the extent caused by factors outside our reasonable control.
11. Indemnity
You agree to indemnify WiseEnding against claims arising from your misuse of the Service or violation of these Terms or the rights of others.
12. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which WiseEnding operates (to be finalized before launch). Disputes will be handled in the competent courts of that jurisdiction, unless applicable law requires otherwise.
